Terms of Service
Effective November 7, 2026
1. Who we are and these terms
RentStack is operated by RentStack LLC, a Wisconsin limited liability company ("RentStack," "we," "us"). These Terms of Service ("Terms") apply to everyone who uses rentstackhq.com and the RentStack app (the "Service"): landlords and their team members, tenants, vendors, and website visitors.
By creating an account, accepting an invitation, or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service for a company, you confirm you can bind that company, and "you" includes it.
2. Who can use RentStack
- You must be at least 18 years old and able to enter a binding contract.
- The Service is for residential rentals in the United States.
- Landlords may not use RentStack for any business Stripe does not allow.
3. Accounts
- Give accurate information and keep it up to date.
- Keep your password private. You are responsible for activity on your account.
- Tell us right away at support@rentstackhq.com if you think someone else has used your account.
- Tenants and vendors are invited by a landlord. A tenant account is linked to that landlord's company. A vendor uses a secure work-order link and does not need an account.
4. What RentStack does
RentStack is software that helps landlords collect rent, send invoices and reminders, track repairs and vendors, message tenants, prepare notices, and keep expense and income records. We may add, change or remove features over time. If we remove a core feature from a paid plan, we will tell you first.
RentStack is not a landlord, property manager, real estate broker, law firm, bank or money transmitter. We are not a party to any lease between a landlord and a tenant.
5. Landlord responsibilities
If you are a landlord, you are responsible for how you run your rentals, including:
- Your leases, rent amounts, late fees, security deposits and charges, and making sure they follow federal, state and local law.
- Fair housing laws. You may not use RentStack to discriminate against anyone.
- Choosing, filling in, serving and relying on any notice, and any eviction or court filing.
- Having your tenants' permission to add them, and to contact them by email or text.
- The vendors you choose, their work, and paying them.
- The accuracy of what you enter, including payments you record as received in cash or by check.
6. Tenants and vendors
- Tenants use RentStack to pay rent, request repairs, message their landlord, see their lease and give notice. Your lease is with your landlord, not with RentStack. Questions about rent amounts, fees, deposits or repairs go to your landlord.
- Vendors use a work-order link to schedule, message and send invoices for a repair. Keep the link private. It works only for that repair and can be turned off by the landlord.
7. Payments
Stripe processes every online payment. To collect rent online, a landlord opens their own Stripe account through RentStack and agrees to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. Stripe, not RentStack, verifies identity, holds funds and pays them out.
- RentStack never holds your money. Rent goes from the tenant to the landlord's Stripe account, then to the landlord's bank.
- We never collect bank account numbers, card numbers or Social Security numbers. Stripe collects those directly.
- Convenience fees. When a tenant pays online, the tenant pays a convenience fee that covers the payment processing cost. It is shown, with the total, before the tenant pays, and is never added to the rent. Tenants can always pay their landlord another way the lease allows, such as a check.
- Current fees:
| Tenant pays by | Tenant's fee | Landlord receives |
|---|---|---|
| Bank transfer | 0.8% of the payment, rounded up to the next 5¢, $5.00 maximum | The full rent |
| Credit card | 3% of the rent | The full rent, less up to 30¢ of card processing cost |
| Debit or prepaid card | No fee (card rules don't allow one) | Only if the landlord accepts debit cards; the landlord then pays the card processing cost (about 3%) |
- Debit and prepaid cards. Card network rules don't allow a fee on debit or prepaid cards. Debit cards are not accepted unless the landlord turns them on in Settings. A landlord who accepts them pays the card processing cost on those payments. RentStack checks the card type before any card is charged.
- Returned payments. A landlord may set a returned payment fee in Settings. If a tenant's bank transfer is returned (for example, for insufficient funds), that fee is added to the tenant's balance and the tenant is notified. The fee goes to the landlord, never to RentStack. Landlords are responsible for making sure the fee is allowed by their lease and by state law.
- We will show any change to these fees before it applies.
- Payout timing is set by Stripe. Standard payouts usually take about 2 business days. Instant payouts, where offered, cost the landlord Stripe's instant payout fee (currently 1.5%, minimum 50¢).
- Bank transfers can take up to 4 business days to clear and can be returned by the tenant's bank. A returned payment means the rent is unpaid again.
- Refunds and disputes are between the landlord and tenant. Landlords handle refunds and card disputes in their Stripe Dashboard. Stripe's dispute fees apply to the landlord's account.
- Recorded payments. Cash, checks and other payments a landlord marks as received are records only. RentStack does not verify them.
- Vendor payments marked as paid in RentStack are records only, unless paid through a feature that says otherwise.
8. Plans and billing
| Plan | Units | Monthly | Yearly |
|---|---|---|---|
| Starter | 1 | Free | — |
| Essential | up to 6 | $45 | $450 |
| Plus | up to 14 | $75 | $750 |
| Pro Portfolio | up to 30, then $2 per unit per month | $100 | $1,000 |
- Paid plans are billed in advance through Stripe and renew automatically each month or year until you cancel.
- You can change plans anytime. Upgrades take effect right away with a prorated charge. You can't stay on a plan smaller than your unit count.
- Cancel anytime in Settings. Your plan stays active until the end of the period you paid for. We don't refund partial periods, except under the guarantee below or where the law requires.
- If a payment fails, we'll tell you and retry. After repeated failures your account moves to Starter until you update your card. Your records are kept.
- We may change prices with at least 30 days' notice before your next renewal.
- Tenants and vendors never pay RentStack. Tenants pay only the convenience fee on online payments.
9. The 30-day guarantee
If you don't collect your first rent payment online through RentStack within 30 days of starting a paid plan, your next month is free.
To qualify, within those 30 days you must:
- Finish your payout setup with Stripe.
- Add at least one active lease and invite that tenant to RentStack.
- Ask us for the credit at support@rentstackhq.com within 60 days of starting your plan.
The guarantee is a credit of one month of your plan's monthly price, applied to your next bill. It is not paid in cash. One guarantee per company. It doesn't apply to Starter, or if your Stripe account is restricted for reasons outside our control.
10. Notices, templates and suggestions are not legal advice
RentStack suggests notices, fills in templates, counts down deadlines and shows general information about landlord-tenant rules. This is a convenience, not legal advice, and no attorney-client relationship is created. Laws change and depend on the facts, the lease and the property. Before you serve a notice, file an eviction or rely on a deadline, check the law that applies to you, and talk with a landlord-tenant attorney if you are unsure. You are responsible for the notices you serve.
11. Lease reading
When you upload a lease, RentStack uses an AI service to read it and fill in fields like names, rent, dates and deposit. Automated reading can be wrong. You must check every field before saving. We are not responsible for errors you don't correct. Uploaded leases are processed by our AI provider only to provide this feature (see the Privacy Policy).
12. Acceptable use
You may not use RentStack to:
- break any law, including fair housing, debt collection, consumer protection and privacy laws;
- harass, threaten or discriminate against anyone;
- send messages or texts people did not agree to receive;
- upload anything you don't have the right to share, or malware;
- try to get into accounts, data or systems that aren't yours, or overload or reverse engineer the Service;
- collect rent or payments for anything other than residential rentals you have the right to manage.
13. Your data
- You own your data. Landlords own the property, lease, tenant, payment and expense records they put in RentStack. You give us permission to store and process them only to run the Service for you.
- You can download your records, such as report and tax CSV files, at any time, including after you cancel.
- We may use anonymous, combined statistics that can't identify you or your tenants to improve the Service.
14. Ending your account
- You can cancel anytime. We keep your records for at least 90 days after cancellation so you can download them, then we may delete them, except where the law requires us to keep them.
- We may suspend or close an account that breaks these Terms, puts others at risk, or that Stripe has restricted. Where reasonable, we'll warn you first.
15. Disclaimers
The Service is provided "as is" and "as available." We work to keep it running and accurate but don't promise it will be uninterrupted or error-free. To the extent the law allows, we disclaim implied warranties, including merchantability and fitness for a particular purpose.
16. Limit of liability
To the extent the law allows, RentStack is not liable for indirect, incidental, special or consequential damages, or for lost rent, profits or data. Our total liability for any claim is limited to the amount you paid RentStack in the 12 months before the claim, or $100 if you paid nothing.
17. Indemnity
If you are a landlord, you agree to defend and hold RentStack harmless from claims arising from your rentals, your leases and notices, your dealings with tenants and vendors, or your breaking these Terms or the law.
18. Law and disputes
These Terms are governed by Wisconsin law. Any dispute will be handled in the state or federal courts in Milwaukee County, Wisconsin, unless the law requires otherwise. Please contact us first; most issues can be solved quickly.
19. Changes and contact
We may update these Terms. If a change is significant, we'll email account owners or show a notice in the app at least 30 days before it takes effect. Questions: support@rentstackhq.com · RentStack LLC, 5151 S Howell Ave, Suite A, Milwaukee, WI 53207.
